CITIZEN ACTION DEFENSE FUND JOINS BUSINESS GROUPS IN AMICUS BRIEF IN CAPITAL GAINS INCOME TAX CASE

Olympia, Washington State— December 12, 2022 — Today, the Citizen Action Defense Fund (CADF), jointly filed an amicus brief along with the Association of Washington Business, Technology Network, and Ethnic Chamber of Commerce Coalition in the case Quinn v. State of Washington pending before the Washington State Supreme Court challenging the capital gains income tax. The Court is reviewing whether to uphold a trial court ruling that struck down the tax as unconstitutional. Oral argument is set for January 26, 2023. In the brief, the group argues that the tax will discourage investment and will result in double taxation.

“As our brief makes clear this tax is bad policy and bad law. The State Supreme Court should follow the well-reasoned decision of the trial court in this case and strike down this unconstitutional tax. ” said Jackson Maynard, Executive Director of CADF. “The Court should also decline the State’s invitation to overrule 100 years of caselaw. We are proud to join AWB and others in our state in pointing out the risks to businesses and individuals if the Court allows this tax to go forward.”

The government watchdog nonprofit files lawsuits, represents affected parties and intervenes in cases when the state enacts laws that violate the state or federal constitutions, when government officials take actions that infringe upon the First Amendment or other constitutional rights, or when agencies promulgate rules in violation of state law.
